One more irrelevant theory.
Father Michael P. Orsi is chaplain and research fellow in law and religion at Ave Maria School of Law.
Orsi took to the pages of the Washington Times to explain How same-sex marriage won.
According to Fr. Orsi it all started in 1930 when the Anglican Church decided that it would no longer prohibit contraception. Who knew that would lead to “the destruction of marriage?” Moreover, the Catholic Church is supportive of Natural Family Planning. In other words, even devout Catholics have recreational sex. Condoms are simply more effective than NFP.

Father Orsi is a well educated man (Ed.D from Fordham). Yet he believes Justice Scalia’s demagoguery. Justice Kennedy, in his opinion, never said that people who are opposed to same-sex marriage are enemies of human decency.
This is all about equal protection and equal liberty. If a state recognizes same-sex marriage then the only reason that the federal government would not recognize it is out of animus for gay people. The federal government, for example, does not apply discretion in the marriages of convicted murders, child molesters or rapists. DOMA seems to be the only law in existence that provides differentiation between state and federal recognition of marriage. According to Orsi:
Justice Antonin Scalia points out in his dissent: “By formally declaring anyone opposed to same-sex marriage as an enemy of human decency, the majority arms well every challenger to a state law restricting a marriage to its traditional definition.”
Father Orsi indulges in a nonsensical warning.
For those religious traditions that oppose same-sex marriage, Justice Scalia’s jeremiad deserves special note. A word to the wise is sufficient.
In the final analysis, the Court made a decision grounded in civil law that Orsi and Scalia don’t like and probably for the same reason. Their church maintains that we are disordered.
