Lorie Smith

Website designer Lorie Smith — owner of 303 Creative in Littleton, Colorado — has not been asked to create a web site for a same-sex wedding.  Represented by Alliance Defending Freedom, Smith is going to court with a pre-enforcement challenge to Colorado’s nondiscrimination laws. She wants permission to discriminate against gay people. The request for a preliminary injunction is below (it is shorter and easier to get through than the complaint).

This is nearly identical to another ADF pre-enforcement challenge in Phoenix (Brush & Nib). They have already lost the first round.

Smith’s lawyers at ADF know that they are going to lose. Littleton is about three or four miles from Lakewood, CO which is home to another ADF client, Masterpiece Cake Shop. ADF has lost every round of the myriad of cases like this that they have handled. They were even rebuffed at the Supreme Court. There is ample precedence that there are no religious exemptions to otherwise valid laws. Were that not the case I would have founded the Church of Taxes Are Evil years ago. It doesn’t matter. Win or lose it is all about donation bait. Indeed, losing has a certain unique ka-CHING to it. ADF has already put up the web page about the poor Christian business owner who just wants to live out her faith.

Refusing service to people one disapproves of, all neatly cloaked in scripture, has little to do with keeping faith. Rather, it is about giving people the opportunity to express their disapproval in spite of the fact that no one has asked for their endorsement. Nor is it required. Some of these folks are desperate to have some control over others. Making a website for a gay wedding is a strictly secular endeavor.

Call me a cynic. Lorie Smith is a bigot but there might be another angle to all of this. The business was registered nearly five years ago. Ms. Smith boasts of 67 clients and 35 websites. That’s not much business. After some negative coverage she can always go to crowd funding. Getting donations from Christian sympathizers might be far more lucrative than her tiny business. But as I said, I am a cynic.

Just in passing it seems that local news got wind of her litigation and Lorie was getting hammered on twitter. @lorie303 no longer exists.
